Short description of the contract or purchase(s):

The contract is for the delivery of Facilities Management and Property Related Services in the Asia Pacific region, for the safe and satisfactory operation of the specified sites, through a performance specification. Service Providers must provide a fully managed service, acting as a prime contractor with single point responsibility for managing and delivering all the services at the specified sites. Service Providers must co-ordinate and integrate activities of their supply chain, including consultants, subcontractors and suppliers, to achieve the specified requirements. The awarding Authority is seeking reputable Service Providers with a strong customer focus and service provision, that are keen to work in an environment of innovation and continual improvement. Service Providers will also be required to deliver the contract in accordance with the UK Government/Awarding Authority's policies on High Performing Property, Property Asset Management, applicable Health and Safety, Sustainability and Environmental policies and all other relevant policies including emerging best practice. The contract will include options for the successful supplier to provide some or all of the services procured under this competition to (i) other departments or agencies of the UK Government listed in the Civil Service Yearbook from time to time; (ii) more of the Authority's property in Asia Pacific and other overseas locations; and (iii) other public/private properties for which Facilities Management and Property Related Services become the responsibility of the Authority.Building and facilities management services.

This OJEU is structured in 3 Lots. The Authority has a preference to contract with a single Service Provider for the whole of the Asia Pacific region provided it can be demonstrated (either through PQQ responses or through Dialogue) that such an approach is both viable and economic. As a result organisations responding to this PQQ must indicate whether they are responding in respect of all or one or more lots.

ADDITIONAL INFORMATION:

A Pre-Qualification Questionnaire (PQQ) will be made available to prospective organisations with the release of this OJEU notice. Those wishing to express an interest to participate in this procurement can request a copy via the contact point in I.1. Prospective bidders should note that their completed PQQs must be returned by Noon (GMT) on the 16.12.2009. In their response to the PQQ, prospective bidders must confirm their willingness to participate in the Invitation to Participate in Dialogue (ITPD) and support any reference site visits, demonstrations and any other due diligence work with the FCO Facilities Management Project Team. The FCO envisages the appointment of supplier(s) for the provision of all services and bidders are required to confirm that they will submit a bid in respect of all services outlined in Section II.2.1. While the FCO will review the financial standing of bidders at the PQQ stage, the FCO reserves the right to exclude any bidder from the procurement in the event that they subsequently fail to maintain the criteria relating to financial standing set out in the PQQ.

If a group of suppliers wish to pre-qualify as a Joint Venture (JV) or create a Special Purpose Vehicle (SPV) to deliver the services, the proposed financial structure of the JV or SPV must be provided together with the financial details set out in the PQQ for each of the parent companies. The FCO will only consider any Joint Ventures or Special Purpose Vehicles from Suppliers that have a track record of working together within such vehicles.

The project is assessed to be unclassified but supplier's staff will be required to have security clearance. Staff should either have existing security clearance or be prepared to undergo UK Government clearance. As stated in Section II above, the FCO will conduct the procurement process on behalf of itself and other departments or agencies of the UK Government as listed in the Civil Service Yearbook from time to time.

The Contract duration will be 7 years following mobilisation (of up to 6 months) with an option for up to 3 additional years. The option to extend shall follow the same parameters established for the initial contract period, unless provisions, which are intended to change, are identified at tender stage. The actual duration will be determined by a range of pricing options at IIT stage. The FCO reserves to itself the right to exercise formal options for the extension of the contract to include more of its properties in overseas locations and buildings occupied by other departments or agencies of the UK Government as listed in the Civil Service Yearbook from time to time.

The FCO reserves the right to abandon the procurement process and not award any contract; and/or to make whatever changes it sees fit to the procurement process.

The final contract shall be subject to English Law and the exclusive jurisdiction of the English courts.

Lodging of appeals:

Precise information on deadline(s) for lodging appeals: The FCO will incorporate a minimum of 10 calendar days standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the FCO before the contract is entered into. Applicants have 2 working days from the notification of the award decisions to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such information should be requested from the address in section I.1. If an appeal regarding the award of the contract has not been successfully resolved the Public Contracts Regulations 2006 (S12006 No5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the FCO to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
