contract or purchase(s): The Highways Agency is
the Network Operator for motorways and strategic roads in To support its needs and
its role as network operator, the Highways Agency has procured the provision
of telecommunications services as a Public Private Partnership, known as the
National Roads Telecommunication Services Project (NRTS Project). The project
has built a new telecommunications network during 2006/07 based on fibre and
copper cables and an Internet Protocol based transmission solution. The
network supports a range of new IP, CCTV and telephony services and existing
bespoke legacy services. To support the Highways
Agency with managing the NRTS contract an external Consultant will be
required to provide specialist support services. The duties of the consultant
shall include the following: 1. Provide technical
expertise to evaluate the NRTS contractor's solutions for delivering and
monitoring telecommunication services; 2. Provide technical
support when auditing performance data for the telecommunications services
delivered under the NRTS contract. 3. Develop requirements for new
telecommunications services and systems and processes for monitoring the
services. 4. Provision of support
to assess the NRTS contractor's proposals when seeking structural,
environmental and geotechnical approvals and other highways and civil
engineering expertise, 5. Support the handback and transition into a "follow on"
contract at the expiration of the current NRTS contract. 6. Provision of legal
and financial advice relating to the development of PFI and similar
contracts, payment mechanisms and performance regimes and advice on Highways,
telecommunications and other relevant legislation and regulations. This
advice may be called upon throughout the term of the contract in relation to
the management and possible amendments to the existing NRTS contract. Legal
and Financial support will also be required when developing a new procurement
strategy, statement of requirements and contract documents for the NRTS
follow-on contract. The estimated value of
the work is expected to be in the range of GBP5M to GBP 19 500 000 the reason
for the range of estimated values is to allow for a range of possible
outcomes of any review of the future procurement strategy for NRTS and the
possible need to re-draft the NRTS requirements and contracts in the later
part of the contract. The contract start date is anticipated to be Spring

deadline(s) for lodging appeals: The Highways Agency will incorporate a
minimum 15 calendar day standstill period at the
point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting
authority before the contract is entered into. Applicants have 2 working days
from the notification of the award decision to request additional debriefing
and that information has to be provided a minimum of 3 working days before
the expiry of the standstill period. Such additional information should be
requested from Procurement Officer named in I.1. If an appeal regarding
the award of a contract has not been successfully resolved the Public
Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who
have been harmed or are at risk of harm by a breach of the rules to bring
action in the High Court (England, Wales and Northern Ireland). Any such
action must be brought promptly (generally within 3 months). Where a contract
has not been entered into the Court may order the setting aside of the award
decision or order the authority to amend any document and may award damages.
