Justification for a framework agreement, the duration of which exceeds four years: The contract is envisaged to be for a 4 year duration commencing in 2010. Dependant on the progress of the procurement/development of the longer term PFI funded facility detailed above, the Council reserve the right to extend the contract to which this notice relates to by up to two years.

Short description of the contract or purchase(s):

Leeds City Council acting as a Unitary Authority has a statutory duty under 51(1)(a) of the 1990 Environmental Protection Act to collect and dispose of Municipal waste materials arising from within the City.

A PFI funded treatment facility is currently being procured and this is expected to deal with the Authorities residual wastes from 2014. However, as an entirely separate exercise and in order to deal with a range of wastes until that point, the Council are now seeking to enter into a new contractual arrangement with private sector contractors who are able to provide appropriately licensed facilities for the acceptance and final disposal and/or treatment of a range of municipal wastes from 2010.

Whilst the Council accepts that landfill capacity will be required to dispose of a proportion of the materials within this contract, we are now looking to take the management of the municipal waste produced further up the waste hierarchy by increasing the amount of materials recycled, re-used and composted to reduce the reliance on landfill and to improve our National Indicator "NI192" performance. As such we will be keen to consider recycling, re-use, recovery and composting options within this tender process. In order to facilitate this, the overall waste arisings within the contract will be divided into 11 lots to enable different options to be offered in terms of disposal/treatment methods for each of the waste streams.

Interested parties are invited to submit bids for one or more of the LOTS available. It should be noted that where organisations bid for multiple lots and where more than one facility is offered, then each submission will be evaluated and awarded separately.

The council will also welcome organisations who may wish to collaborate to form a consortium with a lead organisation or special purpose vehicle ultimately contracting with the city council. This does not preclude a single organisation offering all the services.

It is envisaged that the above approach will provide a framework agreement for the Council, and whilst there remains the potential that one single provider could be awarded the entire tonnage available, bidders should note that it is not guaranteed. In all likelihood we expect the tonnages to be awarded to a number of bidders on a LOT basis where they may win single or multiple LOTS. Similarly there remains the potential for each LOT to be split between one or more bidders.

The contract is envisaged to be for a 4 year duration commencing in 2010. Dependant on the progress of the procurement/development of the longer term PFI funded facility detailed above, the Council reserve the right to extend the contract to which this notice relates to by up to two years. The Council will endeavour to keep successful contractors updated regarding this issue throughout the contract term. Tenderers should also note, that if the Council wish to carry out new services at the end of this contract, which are a repetition of the services detailed in this notice, then those additional services may be awarded using the negotiated procedure without the publication of a further notice.

Contractors are invited to offer facilities whereby the following options can come forward:-.

— The Council will deliver materials directly in order for those materials to be treated/sorted with a view to maximising recycling/reuse opportunities which will contribute to the Councils NI192 performance. In this case the prices submitted shall include all subsequent transfers of saleable outputs and disposal of residues.

— The Council will deliver materials directly to a bulking facility for onward transfer to other treatment/sorting/disposal sites. In this case the Contractor will be responsible for all aspects of onward transportation and all costs relating to that transfer shall be included in the prices submitted,

— The Council will deliver materials directly to their end destination for disposal.

In any case all prices tendered will be a fixed gate fee to the Council for all materials delivered and irrespective of whether the contractor will need to undertake further segregation/transportation.

The evaluation team will give consideration to quality and price aspects of each tender submission and the full details of the evaluation criteria will be provided within the tender documentation. Bidders should note that the proximity principle and geographical location of sites offered will form part of that evaluation. The Council wishes to make it clear that they welcome bids from organisations based outside of the UK, however the Councils own operational/logistical ability in terms of collection systems, dictates that the delivery sites offered are preferably within 10 miles of the boundary of Leeds Metropolitan District.

An important feature of this contract will be the requirement for successful organisations to achieve Key Performance Indicators (KPI’s) relating to delivery of the services. The performance related damages will be applied for repeated or significant failures in terms of meeting those KPI’s. These KPI’s and the matrix of performance related damages will be provided within the tender documentation.

Although Leeds City Council will be the local authority for the purposes of this procurement one or more Partners of Leeds City Council or any of the other local authorities in the Yorkshire and the Humber region may choose to access the concluded framework agreement and order services, without creating any obligation on behalf of any of them to do so. Where any such local authority elects to place an order under the framework agreement a legally binding contract shall be created between the particular local authority and the contractor at that time to which the terms of this framework agreement will apply. In relation to any other public sector organisations who have their headquarters in the Yorkshire and Humber region, they may also place orders under this framework agreement whereupon a legally binding contract shall be created between the particular public sector organisation and the contractor at that time to which the terms of this framework agreement will apply. As the procuring authority, Leeds City Council will have priority over any other Authority or any other body for the use of any capacity available at the facilities offered by bidders through this procurement.

The Transfer of Undertakings (Protection of Employment) Regulations 2006 ("the TUPE Regulations") may apply. Leeds City Council is unable to advise contractors as to whether it applies and we recommend contractors seek their own legal advice in respect of this matter.

This contract is envisaged to deal with approximately 300 000-320 000 tonnes of material spread across 11 LOTS. However these tonnages are not guaranteed arisings as the implementation of various service developments and awareness raising initiatives may impact on the tonnages being dealt with under this contract for each lot.

We are unable to provide an accurate overall contract value for the future provision of the facilities required to deal with the materials. The tender will not be technology specific and it is envisaged that a range of new and emerging technologies may come forward as part of the process and as such a wide range of prices. The estimated value of the contract stated below is based on the current methods of disposal which is primarily landfill.

There are 2 LOTS (LOT 9 and LOT 10) which may or may not be a requirement of this contract dependant on external influences. As such the value of these waste streams have not been included when calculating the approximate contract value.
