3. The Council shall not be bound to accept the lowest or any proposal received, or to award any contract or appoint any advisers pursuant to this procurement exercise. The Council will not under any circumstances be responsible for refunding any costs incurred by prospective financial advisers in preparing a PQQ response or submitting a tender in relation to this exercise (whether contracts are eventually awarded or not). The Council reserves the right to cancel the selection and evaluation process at any stage without liability. Unless you make any formal statement to the contrary, the Council reserves the right to accept any part of the proposal without accepting the remainder. Acceptance of a proposal / notice of a decision to award the contract will be by written communication from the Council.

Lodging of appeals:

Precise information on deadline(s) for lodging appeals: The Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authorities before the Contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such information should be requested from the address stated in section I.1) above. If an appeal regarding the award of Contract has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 no 5) provide for aggrieved parties who have been harmed, or are at risk of harm by a breach of the rules, to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a Contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the Contract has been entered into the Court may only award damages.
