Slough Borough Council seeks expressions of interest from suitably qualified and experienced development partners to provide new civic premises of approximately 80,000 - 90,000 sq ft in Slough town centre, including approximately 5,000 sq ft for use as a civic chamber and civic space. Candidates must own, or be able to obtain, a suitable site in Slough town centre on which these premises could be constructed, within Slough Borough Council's required timescale of December 2011. The successful development partner will be required to design, build and finance the new premises, and, once built, to provide the new civic premises to the Council on a leasehold basis over approximately a 15 year period. The Council's objectives in relation to the new civic premises include, but are not limited to: - the delivery of a contemporary building with a strong civic presence and identity; - the achievement of sustainability in the building (e.g. delivering a building rated 'very good'/'excellent' under the Building Research Establishment Environmental Assessment Method (BREEAM)); - the creation of a flexible and stimulating working environment, that adheres to the latest government guidance on 'new ways of working'; - the delivery of flexible civic accommodation that can cater for potential future expansion requirements of the Council. Candidates are informed that Slough Borough Council is subject to the Freedom of Information Act ('the Act'). If candidates consider that any of the information they give in this procurement procedure should not be disclosed because it is commercially sensitive, or is confidential information that relates to matters affecting the candidate's business (such as technical or trade secrets or the confidential aspects of tenders) or otherwise, they must, when providing the information, clearly identify the specific information they consider should not be disclosed and clearly specify the reasons. Slough Borough Council will take this into consideration if it receives a request for disclosure of a candidate's information but Slough Borough Council may decide to disclose this information despite the candidate's view. It is not sufficient for a candidate to include a statement that all of its information is commercially sensitive or confidential. Slough Borough Council is not liable for candidates' or tenderers' costs in connection with this procurement procedure irrespective of the outcome of the competition, even if the competition is cancelled or postponed. Lodging of appeals:

 

Precise information on deadline(s) for lodging appeals: Slough Borough Council will incorporate a miniumum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from Slough Borough Council before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before expiry of the standstill period. Such additional information should be required from the contact in Section I.1. If an appeal regarding the award of a contract has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into, the Court may only award damages.
