Background:

Ealing Council is embarking on an ambitious programme of regeneration on many of its major housing estates. At South Acton and Green Man Lane estates the Council has been working with residents and, in some cases, masterplanners for some time and outline aspirations are in place for both estates. Cabinet has agreed to commence development options appraisals on a number of estates in order to identify regeneration proposals for each estate. It is expected that a competitive process on an estate-by-estate basis will commence to select a development partner to turn outline aspirations into the delivery of comprehensive redevelopment plans.

Ealing's Housing and Regeneration objectives:

The Council is taking forward the regeneration of the borough’s most deprived estates. In late 2007, a comprehensive assessment of the borough’s 34 largest estates was undertaken to determine the regeneration needs and development opportunities for each estate. A five-year housing regeneration strategy has now been developed which will entail a series of options appraisals and developer competitions to deliver regeneration solutions for High Intervention estates, following resident consultation.

The overall objective is the transformation of these neighbourhoods into vibrant places where people choose to live and work. The Council wishes to achieve this with the cooperation and endorsement of local residents.

This Procurement:

This procurement will create a framework of consultants who will advise the Council in the preparatory work bringing forward projects through options appraisals and consultation into developer competitions.

The framework will be split into 4 distinct lots along the follow disciplines:

Land and Property Consultancy Services.

Design Services

Financial Consultancy Services.

Legal Services

Scope of the framework

Consultants appointed under the framework will support the Council in providing specialist consultancy services to a number of Housing regeneration projects where the Council is preparing to hold open competitions to select private developer partners. These projects will result from the Council’s recent Estates Review, which has identified a number of estates where early intervention is required from the Council.

Consultants will also be required to assist the Council in briefing and training resident groups who will be part of the decision making process.

The estates review high intervention projects are likely to be multi million pound projects in their overall value. This is difficult to quantify exactly as there are alternative ways of estimating principally development value against build cost. Either way the aggregate sum will be substantial.

The Council’s element of this will be reduced to it's obligations to run the selection competitions.

Deliverables / Desired Outcome.

Each consultant procured under the framework will have individual deliverables appropriate to their discipline. For example the Financial adviser will be required to produce an economic model that can be used to assess the quality of developer bidders financial proposals. The desired outcome of this procurement process is to put together a framework of consultants that could be called upon to offer consultant services on an as and when basis. Individual briefs will be prepared for each work package.

Exclusions and Timeframe

The projects to be supported by the framework consultants will be delivered over the next 4 years depending on the individual timescales of each project and developer competition.

This service commission will entail the delivery of the following tasks for Stage 1, 2 and 3 of the Developer Selection process:

— Call off indicative land values in line with planning policy,

— Individual valuations,

— Valuations of leaseholder properties,

— Represent the Council in negotiations with leaseholders and freeholders, and in any associated arbitration proceedings.

This service commission will entail the delivery of the following tasks for Stage 1, 2 and 3 of the Developer Selection process:

— Production of consultative materials plans, diagrams, reports & guidance to support understanding of residents.

— Development of design assessment criteria for evaluation of developer proposals.

— Evaluation of developer proposals against assessment criteria.

— Facilitation of resident involvement in this process and support for the Developer Selection Group to be able to effectively appraise proposals by providing training on specific design issues.

— Urban design input into the Stage 2 and 3 developer briefs to establish aspirations for high quality development schemes.

— Production of a final report on the merits of each Developer proposal at the end of Stage 2 and 3.

Overview of services to be read in conjunction with supporting PQQ documentation:

This service commission covers the delivery of the following tasks for the development options appraisal work, and Stage 1, 2 and 3 of the Developer Selection process:

to model the financial impact of future options for the estate (to include refurbishment, partial and full redevelopment), to test development viability with a range of cost/income/tenure/density variables and to model the impact of the preferred option on the HRA.

— Advise on the production of the financial aspects of briefs at each stage of a competition to select a development partner.

— Review bids received in response to a competition to find a development partner to include a review of PQQ to assess financial capacity of organisations and a review of bidders’ business plans for the development.

— To provide advice and guidance to the developer selection groups that will be established to contribute to this process consisting of residents, members and officers.

— Assist in negotiating with bidders to secure favourable financial outcomes for LBE and residents from the competitive process.

— Draw up written confirmation of the financial aspects of bidders’ submissions to confirm the commercial basis on which successful bidders are shortlisted and selected.

Legal advice will be of a specialist nature and experience of major regeneration/development schemes is essential. This service commission will entail the delivery of the following tasks for the Developer Selection process:

— Advice on the production of the legal aspects of briefs at each stage of the competition to select a development partner.

— Review and help evaluate bids received at each stage of the competition.

— Assist in negotiating with bidders to secure favourable outcomes for Ealing Council and residents from the competitive process.

— Liaise with financial advisers to draw up written confirmation of the financial and legal aspects of bidders’ submissions to confirm the commercial basis on which successful bidders are shortlisted and selected.

Finance Advisors should be suitably qualified and hold relevant practicising certificates associated with recognised professional bodies within the UK or the equivalent outside the UK (For example ICA) and be regulated by the FSA or similar regulatory body outside the UK.

Simlilary for Design Services it is expected that those offering the services are suitably qualified members of RIBA or similar body and those offering valuations services are members of RICS or similar body. It is expected that those bidders outside of the UK would also hold similar professional qualifications and belong to the appropriate professional bodies within their country.

Any supplier who does not comply with the above but who thinks they are suitable to perform the required services must demonstrate why they believe they are capable of meeting the Council's requirements.
