Peterborough Secondary Schools PFI Project.

 II.1.6) Description/object of the contract: 

The design, build, finance and operation of a grouped schools project in Peterborough under the United Kingdom Government's Private Finance Initiative ('PFI'). PFI projects require the Service Provider to bear a significant proportion of the risks associated with the delivery of the project.

The project is expected to comprise the construction of 1 new secondary school and the refurbishment and partial development of 2 existing secondary schools together with the ongoing provision of maintenance and a range of facilities management services to the schools (some of which services are included in the example CPV numbers set out below). A range of community and sports facilities are expected to also form part of the project that will provide income generation potential.

The Council reserves the right to include a BAFO stage in the procurement; to amend the scope of the services and to increase or reduce the number of schools within the project; to require further associated services to be undertaken under the project; to seek a repetition of the services through a negotiated procedure; to amend the contract duration specified in II.3; and/or not to award a contract pursuant to this notice.

Bidders should note that the Council anticipates that the TUPE Regulations will apply. Bidders should, therefore, note that any risks associated with the Acquired Rights Directive 77/187 (as amended) will be transferred to the successful bidder on award of the contract. The Council will require the observance of the Code of Practice on Workforce Matters in Local Authority Service Contracts for this project.

This project has been approved for procurement under the PFI by the Department for Education and Skills and the Project Review Group.

The Council will be holding a Bidders Open Day in the week commencing 22.11.2004 (the precise date to be confirmed with despatch of the Pre-Qualification Questionnaire). Bidders should note that the Council may hold interviews in the week commencing 13.12.2004.

The Council is a public authority under the Freedom of Information Act 2000 which comes fully into force on 1.1.2005.

As part of its duties under the Act, the Council may disclose information to a person making a request unless the information is covered by an exemption under the Act. The Council is required to determine whether the public interest in maintaining the exemption from disclosing it outweighs the public interest in disclosing it.

Prospective bidders should state in their submissions whether or not they consider the information supplied, if disclosed to a third party, would be prejudicial to their commercial interests and if so, the reasons for such a view. These views will be taken into consideration by the Council when deciding whether to disclose information.

II.3) Duration of the contract or time-limit for completion: construction work is expected to commence early 2006. The construction and commissioning period is anticipated to be in the region of 18 months. The schools are expected to be ready for use at the beginning of the academic year in September 2007. It is envisaged that the project duration will be for 30 years, excluding the scheduled construction period.
